STRANDBAGS LOYALTY PROGRAM TERMS AND CONDITIONS

 

1. DICTIONARY

In this document:

Strandbags means Strandbags Group Pty Limited (ABN 52 002 696 915).

Strandbags Loyalty Program or Program means the loyalty program that Strandbags runs for

its customers.

Member means a person who Strandbags notifies in writing has been admitted as a member of

the Strandbags Loyalty Program, who has activated their account, and whose membership of the

Program has not been terminated. Membership has a corresponding meaning.

Terms and Conditions means the terms and conditions governing the Strandbags Loyalty

Program which are set out below, as varied or supplemented by Strandbags from time to time.

 

2. INTRODUCTION

By joining the Strandbags Loyalty Program you agree to be bound by the Terms and Conditions.

 

3. MEMBERSHIP

3.1. Only Members enjoy the benefits of the Strandbags Loyalty Program.

3.2. To become a Member, and to remain a Member: you must at all times have a valid email

address; you agree that Strandbags has the right to send you emails (including for marketing

purposes) at that email address; and you must not be an employee of Strandbags.

3.3. You may sign-up for Membership in a Strandbags store or via the Strandbags website. After

you do that Strandbags will send you an email setting out what is required to activate your

Membership, and you will need to comply with those instructions.

3.4. If you sign-up for Membership in-store you will be issued with a Strandbags loyalty card

(Loyalty Card) at the store along with a unique loyalty Membership number (Loyalty Card

Number). If you sign-up online, you will be issued with a Loyalty Card Number, although you will

not receive a physical Loyalty Card unless you request one at your local store. Your Loyalty Card

and Loyalty Card Number are for your personal use only and are not transferrable, and it is your

responsibility to keep them safe.

3.5. To be eligible for benefits under the Strandbags Loyalty Program, you must present your

Loyalty Card or Loyalty Card Number and personal details when you buy goods in a Strandbags

store or to be eligible for benefits under the Strandbags Loyalty Program via Strandbags website,

you will need to log into your account using your email address and password. Strandbags is

entitled to regard the person presenting a Loyalty Card or Loyalty Card Number as the genuine

Cardholder or Member and is not responsible for stolen, lost or damaged Loyalty Cards or for

any Membership benefits which are misdirected, lost or otherwise not received. Loyalty Cards

are the property of Strandbags.

3.6. If your email address becomes invalid or for any other reason Strandbags is not able to

contact you at your email address including because you elect to ‘unsubscribe’ from Strandbags

marketing communications, Strandbags may terminate (or de-activate) your Membership. If this

happens you will immediately cease being a Member, but you will still be able to redeem (in the

normal course) any accrued benefits earned before your Membership terminated.

4. BENEFITS

4.1. The Strandbags Loyalty Program runs over two spend periods (Spend Periods) per year,

namely:

1 January - 30 June; and

1 July - 31 December.

4.2. A Member who spends NZ$50 or more on product purchases other than on gift vouchers in

a Strandbags store or via the New Zealand Strandbags website (www.strandbags.co.nz) during a

Spend Period, qualifies for a Strandbags loyalty voucher (Loyalty Voucher).

4.3. The value of a Strandbags Loyalty Voucher is:

NZ$10 for the first ever NZ$50 spend, and thereafter NZ$5 for every NZ$50 that a Member

spends (other than on gift vouchers, and after deducting any refunds) in a Strandbags store or

via Strandbags website, limited to a maximum spend of NZ$3,000 per Spend Period.

4.4. Strandbags will issue Members with Loyalty Vouchers within 3 months after the end of the

applicable Spend Period, with the actual date of issue being at Strandbags entire discretion.

Loyalty vouchers will be distributed via email and it is the Member’s responsibility to ensure that

their email address on their Strandbags Membership account is up to date.

4.5. If a Member purchases goods on lay-by, the total dollar amount of the lay-by will be taken

into account upfront and credited to the applicable Spend Period (and lay-by instalments in any

subsequent Spend Period are disregarded).

4.6. If a Member purchases goods online or through a customer order in store, the purchase will fall into the Spend

Period when the order is shipped or picked up in store, not in the Spend Period when the order was placed.

4.7. If a Member receives a refund on a purchase made during a Spend Period, the refund will be

deducted from the total retail dollar value of purchases made by the Member in the Spend Period

when the refund transaction is made.

4.8. If a Member cannot provide proof of Membership (by presenting a Loyalty Card or providing

a verifiable email address or telephone number) at the time of making a purchase, Strandbags is

not obliged to credit the value of the purchase towards a Loyalty Voucher i.e. the purchase will

not be treated as having been made by a Member.

 

5. LOYALTY VOUCHER CONDITIONS

5.1. Subject to paragraph 5.2, you may redeem your Loyalty Voucher:-

(a) within one month from the date on which it was issued, after which it expires;

(b) in any Strandbags store in New Zealand, except subject to Clause 5.2 (c) below;

(c) against a purchase via the Strandbags website; and

(d) against the current selling price of full price and on-sale product.

5.2. You may not redeem your Loyalty Voucher:-

(a) after the expiry date reflected on the Loyalty Voucher;

(b) in conjunction with any other offer or promotional voucher;

(c) at any Strandbags Factory Outlet store;

(d) on a prior purchase, existing lay-by or on the purchase of gift vouchers.

5.3. Your Loyalty Voucher must be redeemed in full in a single transaction and no cash or credit

will be issued for the balance of your Loyalty Voucher if you have not redeemed it in full.

5.4. You may only redeem one Loyalty Voucher per transaction.

5.5. If you return a purchase that was made using a Loyalty Voucher, your Loyalty Voucher will

be re-instated with the same expiry date as the original Loyalty Voucher. If that original Loyalty

Voucher has already expired, you will be issued with a credit note which may be redeemed

against a future purchase within 30 days from the date of issue.

5.6. Your Loyalty Voucher is for your exclusive use only and is non-transferrable. Its value will

not be replaced if it is stolen, lost or not received.

 

6. PRIVACY

6.1. By becoming a Member you consent to:

(a) Strandbags collecting personal information about you for the purposes of your participation in

the Strandbags Loyalty Program and Strandbags marketing and sales activities generally;

(b) receiving communications from Strandbags regarding Strandbags latest products, offers and

competitions;

(c) receiving communications from Strandbags about third party products, discounts and offers

which Strandbags believes may be of interest to you; and

(d) Strandbags using and sharing your personal information with a service provider or agent

retained by Strandbags for the purposes of conducting market research, data warehousing, data

analysis and advertising in the commercial interest of Strandbags and for the purpose of

ensuring the proper functioning of the Strandbags Loyalty Program.

6.2. Strandbags will take all reasonable steps to ensure the security and privacy of all your

personal information and data collected from and about you.

6.3. Strandbags will not otherwise disclose or permit the use of any of your personal information

unless required by law.

6.4. You may access and update your personal information at any time by: visiting the

Strandbags Loyalty Program section of the New Zealand Strandbags website at

www.strandbags.co.nz and logging into your Account Management page; or by emailing

Strandbags Customer Service at customerservice@strandbags.com; or by calling Strandbags

Customer Service on +61 2 9479 7777; or by writing to: Strandbags Loyalty Program (Privacy),

7. TERMINATION

7.1. You may terminate your Membership at any time without reason by doing any of the

following:-

(a) logging into the Account Management page in the Loyalty section of either the New Zealand

Strandbags website at www.strandbags.co.nz and choosing to ‘unsubscribe’;

(b) selecting the ‘unsubscribe’ option on emails sent to you by Strandbags;

(c) notifying Customer Service by email at customerservice@strandbags.com;

(d) notifying Customer Service by phone on +61 2 9479 7777; or

(e) notifying Strandbags by post addressed to: Strandbags Loyalty Program (Privacy), Locked

Bag 77, St Ives NSW 2075, Australia.

7.2. Strandbags has the right at any time without notice and in its absolute discretion to suspend,

change or terminate the Strandbags Loyalty Program including all or any Terms and Conditions.

7.3 Strandbags has the right to terminate a person’s Membership as provided in paragraph 3.6

above.

7.4. Strandbags has the right at any time and for any reason to terminate a person’s Membership

with immediate effect by notice to that person.

7.5. Strandbags is not liable for any loss or damage occasioned by any suspension, variation or

termination of Membership in accordance with the Terms and Conditions, except for any liability

which cannot be excluded by law.

7.6. If your Membership terminates during a Spend Period, you will still be issued a Loyalty

Voucher for any accrued benefits earned before termination, as detailed in Clause 4.4 above,

and will be able to redeem your Loyalty Voucher in the normal course. If, for any reason, you do

not wish to receive a Loyalty Voucher, please notify Customer Service by email at

8. OTHER PROMOTIONAL OFFERS

The Terms and Conditions apply to the Loyalty Program in general. Strandbags may from time to

time run specific offers including competitions within or outside of the
